These Terms of Service ("Terms") govern your access to and use of the Nalvera platform, website, and APIs (the "Service"), operated by Nalvera BV ("Nalvera", "we", "us"). By creating an account, accepting these Terms at registration, or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.
The Service is intended for research use only. It is not a medical device, is not CE-marked or FDA-cleared, and has not been validated for clinical use. Outputs (including segmentations, classifications, and generated images) are not intended or fit for diagnosis, screening, treatment, monitoring, or any other medical decision concerning an individual patient.
You must not use the Service, or rely on its outputs, for clinical or diagnostic purposes. Any use of the Service in connection with patient care is solely at your own risk and responsibility, and is outside the intended use of the Service. All outputs require independent verification by a qualified researcher before any use.
The Service offers a free Guest tier and paid memberships, together with optional credit top-ups. Credits are consumed per job, and some features require a paid membership or a sufficient credit balance. Pricing, credit allocations, membership benefits, and any applicable terms are shown on the Pricing page at the time of purchase; payments are handled by our payment processor, Stripe. Uploaded datasets are stored for 90 days by default, and you can extend storage per dataset with credits, as described on the Pricing page and in the Privacy Policy. You are responsible for all activity under your account and for keeping your credentials secure.
How we collect, use, store, and protect your data is described in our Privacy Policy, which forms part of these Terms. In summary: your uploaded imaging data and AI outputs are processed solely to deliver the result you request, and are not used for any secondary purpose unless you explicitly opt an individual job into research on the results page. Where you provide that per-job opt-in, you grant Nalvera the licence set out in the Privacy Policy to use that job's scans and outputs for research, model development and improvement, benchmarking, validation, and related purposes. Imaging and account data are hosted within the European Economic Area (EEA).
As between you and Nalvera, you retain all rights in the imaging data you upload and in the AI outputs generated from it. Nalvera claims no ownership of your data or outputs, except for the limited licence you grant for any job you opt into research (see Section 5). Nalvera and its licensors retain all rights in the Service itself — including the platform software, user interface, and brand — and the underlying AI models are made available by their respective providers under their own licences. Nothing in these Terms transfers ownership of the Service, or of those models, to you.

You may stop using the Service and delete your account at any time; on deletion, your data is removed in accordance with the retention periods in the Privacy Policy (certain billing records are retained where required by law). We may suspend or terminate access if you breach these Terms, if required by law, or where necessary to protect the Service, other users, or third parties — with notice where practicable. Provisions that by their nature should survive termination, including Sections 2, 5, 6, 10, and 11, continue to apply.
If you use the Service as part of a team or organisational (lab) account, or under a partner or affiliate arrangement, additional terms may apply. Organisations that require a formal Data Processing Agreement (DPA) can request one via our contact page. Partner and affiliate arrangements are governed by the separate terms provided when you join those programmes. Where such additional terms conflict with these Terms for the relevant use, the additional terms control for that use.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that outputs are accurate, complete, or suitable for any purpose, and in particular make no warranty of clinical or diagnostic validity.
To the maximum extent permitted by law, Nalvera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on the Service or its outputs — including any use in a clinical or diagnostic context, which is outside the Service's intended use. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
We may update these Terms from time to time. Material changes are versioned; continued use after a new version takes effect, or re-acceptance where prompted, constitutes acceptance of the updated Terms.
